Brexit Changes

Procurement: The references to the EU Procurement thresholds in our Model Standing Order 18 still apply for the purposes of the Public Contract Regulations 2015 and Utilities Contracts Regulations 2016. However, the end of the transition period has brought in new advertising requirements and the introduction of "Find a Tender". Government guidance, which includes procurement policy notes, FAQs and a flow chart, sums up the main points at www.gov.uk/guidance/public-sector-procurement-from-1-january-2021. Procurements that were commenced prior to the end of the transition period are to be concluded on OJEU/TED, but new procurements must now be advertised on 'Find a Tender'. Current requirements to also advertise on 'ContractsFinder' remain unchanged.

Data protection: The EU GDPR no longer applies directly in the UK. However its requirements must now be complied with under a regime known as "the UK GDPR" which follows the Data Protection Act 2018 and other Regulations. So, much the same as before!
